Re: It finally happened (AaronD)

I just went to court for a ticket in Rutherford section of the NJ turnpike. I was speeding 85 in a 55. I paid $450 for a no point careless driving plea. Not sure for MD residents, but they allow NJ residents to claim that pleas twice every 5 years. Maybe ask the prosecuter about that? Good luck.

yeah its not cheap...i was in court for a red light ticket or something and i remember hearing the people in front of me...3 points was near $650-$700....hats why i say, it might actually be cheaper to pay the ticket and have the insurance go up a bit...since it sounds like you have a nice clean record.

Lucky you're not going any quicker than you all ready were. If you were going any quicker the officer can impound your vehicle and slap you with wreckless driving on top of your speeding ticket.
See if you get points in your state because of the ticket. If you don't get points on your license, it may be cheaper to pay it off, it should run you around $235. If you'll end up with points, go to court and plea bargain for a careless driving ticket, its a little more, but less points.

Also, is it a good idea to try and talk to the officer before court? Your help is greatly appreciated.

Actually, better than just talking to him, why not slip him a $50 bill as well

Good Luck with it. http://****************.com/smile/emthup.gif

A few days before your court date, you can call the court and tell them you need the date posponed. This will by you extra time to face the music. I think you can do this several times. They will tell you if you can move it gain after that. You can use the excuse of being so far away and not being prepaired. Good luck.

Here in MA they only allow one postponement and no more.

usually this is bribing a law officer and doesn't help your situation IIRC.

Here's the NJ point list.
You were issued a ticket for 90 in a 65, so 25 MPH over the limit, here's your penalty:
39:4–99 Exceeding maximum speed 15-29 mph over limit - 4 points.
Ouch.

you have to see how many points maryland transfers from NJ... alot of the time it's a even 2 points for each defense provided you were found guilty.. i am not saying that is definitely the issue, but check into the maryland laws and find out... it might not be 4 points on your license since you were out of state.
my guess is since you were an out of state driver he was going to give you a ticket no matter what you said because it's revenue for NJ and because you probably won't get all 4 points like you would if you were a NJ driver...
just my 02 cents..
Definitely try to talk to the officer before court, if possible. They will usually plead you down in the interest of reducing points, and you're likely to get a good deal since you have a clean record. You probably won't get all 4 points taken off though. You can go take a defensive driving class which will take 2 points off, so you might be able to get yourself back down to 0 points.
The fine will be a bit hefty, and you'll probably have to pay it, plus a $200+ court surcharge just to get to court. It's complete and total extortion.

Re: It finally happened (BlueNJ.:R32)

After doing some research I found out that the conviction transfers to my MD record but the points don't. I'm not sure what this means insurance wise. I'm thinking my premium will go up a little once they see the ticket on my record but hopefully it will go back down once I turn 25 in October. I'm still going to postpone the court date a few times and go up there hoping the cop doesnt show.

Re: It finally happened (muratti)

The "continuance" game rarely works.
The courts are just as aware of this loophole as the civvies are, and they usually have an officer that acts as a prosecutorial representative.
The officer is tasked to the court, they read the reports, etc.
If you really want to reduce it, go to the court early and find the prosecutor and make a deal.

Re: It finally happened (Jman5000)

sorry about the ticket, but things could always be worse.
i would advise a couple of things:
1. do not speak to the police officer, it can't help and may hurt if you try to do something like argue with him or try to bribe him. he can testify about anything you say to him, so if you are not careful you may admit blame, etc. that can be damaging or misconstrued in court. he is doing his job, the ticket has been written, move on to the next phase (pre-trial preparation).
2. definitely speak to a lawyer. this is the way to go. with all likelihood you will not have to appear in court (he can get you to sign a waiver and he can appear on your behalf; you won't do anything anyway except stand there and answer when and what your lawyer tells you to. if he is worth his mettle you can definitley plead guilty to lesser charge (push for nonmoving violation because of no prior speeding tickets in the past 5 yrs.), pay a hefty fine, and go to driving school (hopefully in your area but not sure). if you can't get a lawyer in that area you can use a local attorney provided he is admitted to the bar in nj, and you will have to pay him more to go court out of town. as was stated above in this thread, the amount you spend now on an attorney will more than pay off in insurance savings later.
a thread like this gives us all an oppurtunity to pause and consider the perils of speeding, myself included. as an er physician i see too often young people, usually when mixed with alcohol or drugs, who devastate their own lives, the lives of their loved ones, or innocent bystanders who may be involved in the accident as a result of speeding. let's all be careful and keep the racing as much as possible to the track!!
good luck
