Second haldex failure in a year: looking for advice

Yes, I've searched, but haven't found any threads that have been updated with resolutions, so here's my situation:

2016 R:
  • 2nd owner
  • Tune
  • Full exhaust
  • lowering springs
  • Upgraded clutch
Oil change every 5k. Haldex service every 10k. I'm very much a mature owner and driver, doing the best I can to take care of a nice car.

What happened:
  • Haldex serviced at 30k and 40k. Failure at 43k.
  • Replaced under warranty at 43k in 12/19
  • Haldex serviced at 59k in 3/21. Tech noted high volume of clutch material in the pump screen, which was concerning.
  • Haldex failed yesterday at 60,xxx as evidence of the rear completely locking up multiple times on me at various speeds.
Dealer has confirmed diagnosis. I've firmly stated that this should be covered under warranty again, knowing it's modified and technically outside of the 12mo/12k warranty timeframe (by only 6 months and 1k miles). Dealer stated that he would advocate for my best interest, but the VW rep will at best do a 50/50 split on repair costs. I know my argument is subjective, but it's a pretty clear case that I received a bad replacement unit 18 months ago, which is why it failed so soon, even when I serviced it for the first time back in March very much before the manufacturer suggested service interval. What are your thoughts, opinions, or possible options?

Service rep said the best VW can do "as of right now" is cover 25%. Rep gave me a max figure of $2,800 out-of-pocket. I told him of my concern that it was not installed/lubricated correctly when it was replaced by them and asked if there was room for haggling. He gave me the customer care #, but no luck, they gave me the run-around as anticipated.

Update 6/10/21
Service rep confirmed there were two different lubricants listed on the work order for the Haldex replacement 18 months ago. Though he obviously wasn't there, he insisted that things were lubricated correctly, chalking it up to a freak pre-mature failure. To make sure, I requested fluid samples from the old unit (hoping they hadn't drained it yet). Right now it's still looking like 25% is the best I can get from them.

Validated. I've explicitly requested to have the screen cleaned when serviced. The service done in March, 10k after the new haldex was installed, stated that there was heavy amount of clutch material in the screen.

My assumption is that it was either a bad unit that was installed by the dealer, or the tech mixed up the fluids upon install.

The differential is the issue. The service rep stated the whole differential assembly will be replaced, stating that the haldex is part of it. I asked him about lubrication procedure during installation, and he stated, "it either comes boxed filled, or added during installation. Either way, it's the same fluid, not two different fluids".

something to note: at one point VW had the wrong fluid listed in erWIN. I actually had a long email exchange back and forth with one of the tech guys who kept telling me it was correct. Finally, they reached one of the engineers who explained that yes, the documentation was incorrect. The shop may have been using a fluid capacity chart with the incorrect info--may not even be the tech's fault...

You have zero chance of getting any reliable information handed to you by a dealership. At this point the best you can do is document everything they've said, get under your car and mark your diff with some invisible marker in a few places, get it replaced, demand the old unit back, and split the casing open to see what fluid residue is in there and how exactly it failed. Preferably do the last item in the dealer's parking lot. If it turns out this thing that talks, walks, quacks, and smells like a duck is in fact a duck, maybe you can get some support from VWoA.

Hey if you need just the differential I have one from my 2016 R. We can work something out.

But that diff shouldn't fail like that. Sounds like faulty maintenance via different fluids in the diff vs haldex. I beat my car quiet frequently through corners and no issues here on a 80k mile R with 400hp daily driven.

A little late to the party, but could something be miss aligned? Say the driveshaft, that is putting undo torque or pressure on other components. I have seen 8n the past this type of failure happen on a truck that the pinion angle was a couple of degrees off and the left side of the rear axle housing had shifted in the spring mount due to hard launches from dirt to pavement. The result was a catastrophic failure of the diff. The thing literally blew up inside the housing.
maybe something as simple as a mount or a broken bolt. Just spitballing.
